When a deceased person’s Last Will and Testament is available for review not everyone involved may be satisfied of the result when the provisions of the will are read in conjunction with the legal mandates. Probate litigation is the broad concept of challenging:
- the contents of the Last Will and Testament;
- a provision of the Last Will and Testament;
- the appointment of an executor (Florida law refers to an executor or executrix as a “Personal Representative”); or
- the entire document itself.
Before resorting to litigation consider mediating your claim. It can provide a more speedy resolution and a more peaceful process – especially with loved ones or others involved. Do not create lasting enmity when you can solve your problem and save relationships through the effective process of mediation.
