Mediation
Resolving Legal Conflicts through Mediation
Legal conflict is stressful, expensive, public, and time consuming. Sanchez and Baietto believe mediation is the best and most effective way to work legal conflict out. Studies support this conclusion.
How Mediation Services Work
Mediation is a process in which a mediator helps the parties identify issues; generate and explore options; diffuse tensions and reach a voluntary and lasting agreement. Sanchez and Baietto will guide the parties and attorneys through a careful and complete analysis of the legal issues and also help the parties identify and deal with the underlying issues affecting negotiation such as emotional or economic concerns, personality conflicts and family or organizational dynamics.
Our mediation services are distinguished by our experience and diverse backgrounds which give us the ability to establish solid communication with the parties and attorneys, to build an atmosphere of trust, to identify obstacles and to generate options and solutions. We work hard with the parties and attorneys to break through impasse or avoid it altogether.
Mediation backed by Legal Experience and Knowledge of Human Nature
Cary’s history of social work with seniors including assessments, conflict resolution for families, probate matters, and adult guardianship issues enhance her mediation skills. Brenda’s fifteen years experience in civil litigation, particularly family law and her knowledge of elder law, probate, wills, and adult guardianship matters give parties the security of knowing they have someone in the room familiar with the legality of the issues.
Thorough Preparation for the Mediation Process
Are you seeking to to minimize the expense and risk of a trial, are you trying to avoid the exacerbated conflict that stems from divorce litigation, do you have children who you do not want thrown in the middle of ugly and prolonged litigation, is your client seeking reconciliation, acknowledgment or control in an elder law setting, will contest, probate matter, or adult guardianship matter? Sanchez and Baietto thoroughly flush out conflict and proceed according to the nature of the case and the goals of the participants.
We engage in a complete preparation process in advance of the mediation. We discuss many aspects of the case including who will participate and whether the parties desire a joint session or seek to stay in separate rooms. This type analysis gives the mediation the best chance to work favorably without encountering forseeable issues that should have and could have been worked out prior to the mediation.
